Article 1: Application Fields and Modification of the General Conditions of Sale

 

These general conditions of sale apply to all orders placed on the latelierducil.fr website.
An e-commerce service specializing in the extension of eyelashes (sale of products for
professionals and eyelash extension training) published by the company L’Atelier du Cil.
The publisher reserves the right to adapt or modify at any time these terms and conditions of
sale.
In case of modification, it will be applied to each order the general conditions of sale in force on
the day of the order.

 

Article 2: Availability of products

 

Our product offers and prices are valid as long as they are visible on the site, while stocks last.
Upon receipt of your order, we check the availability of the product (s) ordered (s).
In case of unavailability, we engage in the 30 days (the date of registration of the order is the
date of payment by credit card online with the secure payment terminal of our partner) from the
validation of the ordered:
– to deliver the ordered product to you,
– to offer you a similar product at a similar price,
– or to refund you by check if the amount of the product is greater than 200 € or in the form
of a purchase order if the amount of the product is less than 200 €.
In the case of the issuing of a purchase order, you can on request from our Customer Service
request the cancellation of it and its refund by check or paypal, by email or by mail (however, for
more security, we advise you to proceed to a letter with Acknowledgment of Receipt) at the

In order to properly process your request, thank you to remember the number of your order,
your full details.
In case of out of stock on some products of your order, we ship the order without said
products.

 

Article 3: Validation of the orders and electronic signature (law of March 13, 2000 on the
electronic signature)

Any order validated by “double click” implies irrevocable adhesion to these general conditions of
sale.
The “double click” associated with the authentication and non-repudiation procedure and the
protection of message integrity constitutes an electronic signature.
This electronic signature has value between the parties in the same way as a handwritten
signature.
Title retention clause
The products remain the property of L’Atelier du Cil until the complete collection of the order.
However, upon receipt of the order by the customer, the risks of the goods delivered are
transferred to the customer whether he is the direct receiver or whether it is his representatives.
The transfer of ownership of a property purchased on the site latelierducil.fr by the buyer to a
third person, can not be supported by L’Atelier du Cil.
Only the original buyer of this property can claim access to the clauses of these general
conditions of sale.

Article 4: Prices – Rates

VAT not applicable, art. 293 B of the CGI. The prices quoted do not include the costs of order
processing, transport and delivery.
L’Atelier du Cil reserves the right to change prices at any time, but agrees to apply the rates
displayed at the time of your order, subject to availability on that date.

Article 5: Terms of Payment and Security

 

5.1 Terms of Payment

Payment by Paypal:
Paypal payment is made via a secure banking server. We take care of the transaction costs.

L’Atelier du Cil reserves the right to refuse to make a delivery or to honor an order from a
consumer who has not fully paid or a previous order or with whom a payment dispute is in progress
administration.

Article 6: Terms of delivery and delivery times

The online sale of products and services presented on the site is reserved for buyers who live in
Metropolitan France, Corsica, Monaco, Belgium and Switzerland and in the rest of the world.

All announced deadlines are calculated in working days.
The times indicated are average times and correspond to the processing, preparation and
dispatch times of your order (exit warehouses).
They run as soon as the order is validated.
At this time, it is necessary to add the delivery time of the carrier (Poste // Transporter).
Any item available in stock is dispatched the same day or the next day.
In all other cases, availability may vary between 3 and 30 days depending on the type of
products ordered.

 

6.3 – Delivery times

Delivery times by Colissimo for Metropolitan France and Monaco are 2 working days.

Delivery times by Colissimo for Belgium, Switzerland and Corsica are 4 to 8 working days.
These delivery times are purely informative and do not engage in any way L’Atelier du Cil.

 

6.4 Receipt of articles
L’atelier du Cil is not responsible for items damaged during transport.

Article 7: Responsibilities

The site latelierducil.fr is exclusively reserved for eyelash extension professionals who are
regularly registered or in the process of being registered in the commercial register.
You declare, by ordering on the professional website latelierducil.fr, to know the precautions of
use for the use, the handling and the safety instructions related to the products and techniques
relating to the extension of eyelashes.
L’Atelier du Cil disclaims all liability in the event of misuse of products ordered on latelierducil.fr
Regarding the products purchased to meet the professional needs, L’Atelier du Cil will not be
liable for any indirect damages due to the present, operating loss, loss of profit, damages or costs,
which may occur.
The choice and purchase of a product or service are under the sole responsibility of the
customer.
The total or partial impossibility of using the products notably because of the incompatibility of
the material can not give place to any compensation, reimbursement or questioning of the
responsibility of L’Atelier du Cil, except in the case of a vice hidden proven, non-compliance,
defective.
L’Atelier du Cil can not be held responsible for the breach of the contract concluded, due to the
occurrence of an event of force majeure and in particular in case of total or partial strike of the postal
services, carriers, and disasters caused by floods or fires.

Article 8: Treatment of parcels not distributed by the service provider

These are the parcels that have not been delivered to the final recipient for the following
reasons: NPAI, unclaimed, refused, damaged transport, spoliation…

 

8.1 – Returns under the reason NPAI
These are the parcels returned by the provider responsible for delivery under the mention:
“N’habite Pas à l’Adresse Indiquée”;
After receipt and acceptance of your package by our services, depending on the nature of the
product, available stocks and according to your wishes, we will offer you to reship the product
initially ordered or an exchange product with equivalent characteristics costs being your charge.

8.2- Returns under the reason “refused”
You refused your package at the time of delivery because it showed obvious signs of opening
and / or shocks.
After receipt and acceptance of your parcel by our services, a re-dispatch will be planned,
shipping costs at your expense.

Article 9: Right of return

 

9.1 – Procedure and general conditions of return
If the products need to be returned to us, they must be the subject of a request for return to
our Customer Service:
– within 7 days of delivery for a retraction or if you have not received the correct reference.
– within 15 days for a defective product. In case of return of defective product, after finding,
by L’Atelier du Cil, the defect of the product, L’Atelier du Cil will exchange the articles concerned.
Any complaint formulated outside these deadlines can not be accepted.
For a retraction or if you have not received the correct reference, the return of the product
can only be accepted for products in their original condition (packaging, accessories, instructions).
In an objective of identification and thus of an optimal treatment of the returns, for the
purpose of identification and therefore optimal treatment of returns, any product that needs to be
returned must be the subject of a request for return to our services, under penalty of being refused.

 

The time limit for contacting your customer service depends on the reason for return; please
refer to points 9-2 and following of the GTC.
Upon receipt of the agreement, you have 15 days to return the product.
After this period, your return will be refused.
We suggest you to return by Colissimo.
Otherwise, if the package, shipped by you, and returning to our services, does not reach us,
you would not be able to initiate a survey of postal services to ask them to locate the latter.
Note that any package not shipped by us is not under our responsibility.
Only the sender of the parcel is able to launch a survey with the postal services.
In order to process your request correctly, thank you to remind us your order number and
your complete contact details.
Note: Upon receipt, our services will check the conformity of the returned product and the
reason for return. If the returned product does not comply, it will be refused by us and will be
returned to you at your expense.
If your return is made under a bad reason, your product may be refused and therefore you
will be redirected at your expense.
The return pattern may especially be reclassified.
Therefore, you will be informed by email and the processing of your return will be based on
the new reason.
You will find below the procedure to follow concerning the return of your parcel.
Be sure to follow this procedure so that our services can process your request.
Otherwise, your package will be refused:
Prepare and protect your package carefully: be sure to carefully protect the original
packaging of your package and especially not to write anything on it.
In the case of a retraction, if the product has a label of protection on the packaging, please
do not rip it or try to open the packaging (possible refusal of return, see our Terms and Conditions).
Be sure to return the entire original package.
Include with your package a letter with your exact coordinates, and recalling your order
number with the reason for return.
Reserve:
L’Atelier du Cil reserves the right to refuse the parcel, refund or exchange, if the conditions of
return mentioned above are not respected.
Upon receipt of this product, we will treat your return in order to respond as quickly as
possible to your wishes.

 

9.2 – Returns for retraction

 

Terms of return
In accordance with Article L.121-20 and following of the Consumer Code, you have a period
of 7 working days from the date of delivery of your order, to return any item that does not suit you,
in its original packaging and in good condition, suitable for its re-sale and request exchange or refund
without penalty, except for the return costs.
You have 7 days to inform us that you wish to retract.
ATTENTION:
No retraction will be accepted if the returned product is unfit for its re-sale.

 

Therefore: The product must be returned in perfect condition, in its original packaging,
unopened, unsealed, undamaged, unmarked.
Otherwise, the product will be returned to you, at your expense. In order to process your
request correctly, thank you to remind us your order number and your complete contact details.
Specific conditions for exercising the right of withdrawal.
Returns will not be accepted if the return request is out of time and / or if the original
packaging is no longer cellophane, unsealed, open, torn, marked …
Products sold and destocked will not be returned or exchanged; except in case of hidden
defects.
Processing your return for retraction
After receipt and acceptance of your parcel by our services, depending on the nature of the product,
available stocks and according to your wishes, we will offer you to send you an exchange product of
equivalent value.
The return costs in case of withdrawal remain the responsibility of the customer.

Article 10: Provisions of the law “IT and freedoms”
At any time, you have a right to access, modify, rectify and delete data concerning you (art 34 of
the law “Informatique et Libertés”; of January 6, 1978).
